Cannabis and Tribal/State Relations Update

This report covers recent developments concerning cannabis policy and its intersection with state and tribal governance in Nebraska, Virginia, and Oklahoma.

🇺🇸 Nebraska: Tribal Sovereignty and Tax Compact Dispute

The Omaha Tribe of Nebraska has alleged that the state Attorney General's office is moving to terminate a tribal tobacco tax compact. Tribal officials assert this action is in retaliation for the Tribe's establishment of a medical cannabis program.

Furthermore, the Tribe has indicated that the state intends to deploy additional law enforcement resources along the tribal border, which is also attributed to the Tribe's implementation of its medical cannabis program.

🇺🇸 Virginia: Gubernatorial Election and Adult-Use Market

In Virginia's gubernatorial election, Abigail Spanberger (D) secured the office, defeating her Republican opponent with a vote share of 57.5% to 42.3%.

During her campaign, Spanberger committed to collaborating with state lawmakers to establish a regulated adult-use cannabis market. Her victory follows the term of outgoing Governor Glenn Youngkin (R), who had previously vetoed legislation aimed at regulating cannabis sales.

🇺🇸 Oklahoma: Medical Cannabis Initiative Falls Short

Petitioners for a proposed constitutional amendment aimed at enhancing Oklahoma's medical cannabis program have confirmed the initiative failed to qualify for next year's ballot.

The campaign did not secure the requisite 173,000 signatures.

Organizers commented that the measure would have likely qualified had it been proposed as a statutory measure, which requires a lower threshold of signatures.
